North Carolina Title IX Lawyer

Attorney Matthew Barry is a North Carolina Title IX Lawyer. Located, in Charlotte, he will travel to any School in North Carolina to represent a Student/Employee.

The Title IX Investigation Process is explained in depth by Attorney Barry, at this link.  Throughout the process, a lawyer can be beneficial for both the respondent (accused/subject) or the complainant (complaining witness/victim).

During the investigation itself, a lawyer is allowed to be present when the respondent or complainant is being interviewed. Additionally, a lawyer can help the respondent or complainant collect evidence and provide it to the investigator.  Furthermore, a lawyer can assist in proposing and negotiating an informal resolution to the complaint. Such resolution can ensure that both parties achieve their goals and the respondent mitigates his liability.

After a Title IX investigator completes his/her report, both the respondent and the complainant have the right to submit a response/rebuttal.  A lawyer can, and should, review the report and draft a response/rebuttal on behalf of the respondent or complainant, including additional evidence if applicable.

Furthermore, a lawyer can be present with the respondent or complainant at a Title IX hearing.  While a lawyer cannot advocate at a Title IX hearing, he/she can advise his client on what to say and answer questions. Additionally, lawyers are allowed to, and should, question the other party. For example, the respondent's lawyer gets to question the complainant and the complainant's lawyer gets to question the respondent.

Additionally, at a Title IX Hearing, the respondent and complainant are expected to make opening statements, question witnesses (other than described above), and make closing statements.  A good North Carolina Title IX Lawyer will not only prepare his/her client for questioning by the opposing party's lawyer, but also will create a trial plan. This trial plan should include what to say during opening and closing statements, as well as how to question each witness.

After a Title IX Hearing, a North Carolina Title IX Lawyer can also assist a respondent or complainant in appealing the results.  Appeals need to identify procedural errors, conflicts of interest, bias, or be based on new evidence. An appeal drafted by a lawyer has a higher likelihood of success.

A Title IX investigation that is initiated can have severe consequences.  If a complaint is substantiated, punishment can include:

  • Withdrawal of Privileges
  • Restitution
  • Mental Health/Medical Assessment/Treatment
  • Fine
  • Exclusion
  • Education Projects/Initiatives
  • Community Service
  • Admonition
  • Formal Warning
  • Disciplinary Probation
  • Suspension
  • Expulsion
  • Demotion (employees)
  • Termination of Employment (employees)
  • Other Sanctions/Restrictions on Activities
