Army Promotion Review Results

November 2024: The accused faced a promotion review board due to allegations of sexual harassment and unwanted touching

Result: Promotion to 1LT

The accused, a 2LT with the Army Reserve, faced a promotion review board due a CID Investigation and Battalion Letter of Concern that he received related to allegations of sexual harassment and unwanted touching. As part of his representation in the case, Attorney Willard thoroughly reviewed all of the evidence regarding the accusations that dated back several years, and he worked with the accused to draft a detailed response for the Promotion Review Board’s (PRB’s) consideration, as well as gather multiple support letters for the Board’s consideration. In the end, the PRB sustained the accused’s promotion to 1LT, and he continues to serve in the military to this day.

April 2024: The accused faced potential denial of promotion after a pre-board criminal background check

Result: Promotion to LTC

The accused, an Army MAJ, faced potential denial of promotion when a summary of credible adverse information was uploaded into his AMHRR just before his promotion board to LTC. Attorney Barry drafted a letter to the president of the promotion board, highlighting that the summary of credible adverse information was incorrect and should have no bearing on the accused's promotion.  The promotion board agreed and the accused was selected for promotion to LTC.

February 2024: The accused faced promotion review due to a GOMOR for Driving while Intoxicated

Result: Promotion to CPT

The accused, an Army 1LT, faced a promotion review board (PRB) because of a GOMOR for driving while intoxicated. Attorney Barry drafted the accused's matters for the PRB, highlighting that he only drove after drinking alcohol to stop a Soldier from committing suicide. Attorney Barry also assisted the accused in collecting support from those closest to the situation.  Ultimately, the accused was promoted to CPT.

February 2024: The accused faced promotion review due to a law enforcement report from years earlier

Result: Promotion to CW3

The accused, an Army CW2, faced a promotion review board because of a law enforcement report from years earlier that was discovered upon a post-promotion board screening.  Attorney Barry assisted the accused in drafting additional matters for the Special Selection Review Board (SSRB). Attorney Barry also collected additional evidence for the SSRB demonstrating that the accused had done nothing wrong and never faced any criminal action.  The SSRB ultimately retained the accused's promotion to CW3.

October 2023: The accused faced promotion review due to a substantiated 15-6 investigation for counterproductive leadership

Result: Promotion to COL

The accused, an Army LTC, faced a promotion review board because of a substantiated 15-6 investigation for counterproductive leadership. Attorney Barry drafted the accused's matters to the Special Selection Review Board (SSRB) and assisted him in collecting letters of support. Ultimately, the accused's promotion to COL was sustained by the SSRB.

October 2023: The accused had a "summary of credible adverse information" added to his promotion file

Result: Promotion to MAJ

The accused, an Army CPT, had a "summary of credible adverse information" added to his promotion file before his first look for MAJ.  Attorney Barry drafted a response to this document, adding additional evidence to ensure the Board had the full picture. The accused was promoted to MAJ.

September 2023: The accused's promotion to CPT was delayed due to an investigation

Result: Promoted to CPT

The accused, an Army 1LT, was under investigation for an alleged inappropriate relationship with a CPT. Attorney Barry collected additional evidence and drafted a rebuttal to the investigation, demonstrating that there was no inappropriate relationship.  Ultimately, the accused faced no adverse action and was promoted to CPT with back pay.

August 2023: The accused faced an Article 15 after a Soldier death at Fort Campbell

Result: Promoted to CPT

The accused, an Army 1LT, was under investigation for and faced an Article 15 for a Soldier death that occurred during a field training exercise.  Attorney Barry drafted the accused's matters for the Article 15. While the Accused was found Guilty, his punishment was mitigated and he was promoted to CPT.

July 2023: The accused risked losing his promotion for an alcohol incident

Result: Promoted to CPT

The accused, an Army 1LT, was flagged for an alcohol incident after being selected for promotion, but before being promoted. Attorney Barry collected numerous statements from individuals that had deployed with the accused, who described what his unit went through when deployed to Afghanistan. Attorney Barry also drafted the accused's rebuttal to the Command, resulting in his flag being closed out favorably and him being promoted to CPT.

June 2023: The accused faced promotion review for two domestic violence incidents

Result: Promotion to CW3 Sustained

The accused, an Army CW2, faced a promotion review board because of two police reports for domestic violence incidents. Attorney Barry collected additional evidence for the accused, demonstrating that she was innocent of any wrong-doing. Attorney Barry also collected character letters and drafted the accused's response to the Special Selection Review Board (SSRB). Ultimately, her promotion to CW3 was sustained.

May 2023: The accused faced promotion review for a referred OER

Result: Promotion to CPT Sustained

The accused, an Army 1LT, faced a promotion review board because of a previously referred OER.  Attorney Barry collected additional evidence, letters of support, and drafted the accused's response to the Promotion Review Board. Her promotion was sustained.

February 2023: The accused faced promotion review due to a law enforcement report from seven years earlier

Result: Promotion to LTC

The accused, an Army MAJ, faced a promotion review board because of a law enforcement report seven years earlier that was discovered upon a post-promotion board screening. Attorney Willard assisted the accused in drafting detailed matters for consideration by the Special Selection Review Board (SSRB). Attorney Willard also assisted the accused in collecting additional evidence for the SSRB, which demonstrated that the accused had done nothing wrong and never faced any criminal action. The SSRB ultimately retained the accused’s promotion to LTC.

Result: Promotion Review was Voided; Promoted to MAJ

The accused, an Army CPT, faced review under the Special Selection Review Board (SSRB) for his promotion from CPT to MAJ for an MP Report from years earlier.  The report related to being arrested for having a concealed weapon in the accused's car when entering post.  Attorney Barry drafted the accused's SSRB response, resulting in the SSRB being voided and the accused being promoted to MAJ.

October 2022: The accused faced promotion review for an MP Report from years earlier

Result: Promotion Review was Voided; Promoted to MAJ

The accused, an Army CPT, faced review under the Special Selection Review Board (SSRB) for his promotion from CPT to MAJ for an MP Report from years earlier. The report related to an incident where the accused was arrested for domestic violence.  Attorney Barry drafted the accused's SSRB response, resulting in the SSRB being voided and the accused being promoted to MAJ.

August 2022: The accused faced promotion review for a law enforcement report from years earlier

Result: Promotion to MAJ Sustained

The accused, an Army CPT, faced review under the Special Selection Review Board (SSRB) for his promotion from CPT to MAJ for a law enforcement report from years earlier. The report related to an arrest for shoplifting. Attorney Barry drafted the accused's response and collected additional evidence.  Ultimately, the accused's promotion was sustained and he was promoted to MAJ

January 2022: The accused faced promotion review for a law enforcement report from years earlier

Result: Promotion to MAJ Sustained

The accused, an Army CPT, faced review under the Promotion Review Board (PRB) for her promotion from CPT to MAJ for a law enforcement report from years earlier. Attorney Barry collected additional statements and documents for the accused, and assisted in collecting letters of support. Ultimately, the accused's promotion to MAJ was sustained and she received full back-pay.

October 2021: The Accused received notice that his promotion was under review.

Result: Promotion Sustained

The Accused, an Army Captain, was selected for promotion to Major. After the board, the Accused was notified that there was substantiated adverse information about him that was not presented to the board, and as a result, his promotion was under review. Attorney Gittleman assisted the Accused in drafting his matters to the Board President, explaining his mistake and that he accepted responsibility for his actions. The Accused was promoted to Major.

October 2021: The Accused received notice that his promotion was under review

Result: Promotion Sustained

The Accused, an Army Chief Warrant Officer 2, was selected for promotion to Chief Warrant Officer 3. After the board, the Accused was notified that there was substantiated adverse information about him that was not presented to the board, and as a result, his promotion was under review. Attorney Gittleman assisted the Accused in drafting his matters to the Board President, pointing out that the incident occurred over a decade ago while the Accused was a junior enlisted Soldier. Since then, the Accused was selected to become a Warrant Officer, given a top secret clearance, and selected for several leadership roles. The Accused was promoted to Chief Warrant Officer 3.
